When you have received allegations of inappropriate behaviour or misconduct against a staff member by another member of your staff, a contractor, a student or any other person in your business or undertaking work on behalf of your business.
Organisations are expected to take reasonable steps to respond to complaints of misconduct, particularly where workplace policy may have been breached or where workplace laws, safety obligations, or anti-discrimination legislation apply. A thorough investigation is not only best practise, but also essential to demonstrate compliance with workplace laws, anti-discrimination duties and procedural fairness obligations.


Whilst a senior in-house HR practitioner may feel comfortable handling ‘non-complex’ matters involving junior to mid-tier staff, engaging an independent investigator is the preferred approach for more complex cases. This includes matters with multiple complainants, respondents, or witnesses, cases involving senior members of the organisation or matters with voluminous materials to review. Further, when investigations involve senior managers, the executive team, or the board, it is necessary to ensure impartiality, transparency, and fairness that the individual overseeing the investigation is positioned at a sufficiently senior level within the organisation. This is often not possible, and in such circumstances, consideration should be given to appointing an external investigator.
